Hire Terms and Conditions

In this Hire Agreement:

The ‘Hirer’ is: skinflint Ltd, The Warehouse, Commercial Road, Penryn, Cornwall, TR10 8AE

The ‘Client(s)’ is: The person named. If the business address for communication and service of the Client is not in the UK, then the agent named shall be jointly and severally liable with the customer to the Hirer and the address for communication and service for the Client shall be that of the agent.

‘Goods’ refers to: Any of the products as described by the Hirer in its hire agreement.

Official Order

All transactions with the Hirer are to be on order forms quoting items and hire charges as agreed for a period on a weekly basis. All items to be covered by the Client's official order.

Hire Charges

Charged on a weekly basis as follows:

1st week: 10% of quoted risk value
2nd week: 7.5% of quoted risk value
3rd week: 5% of quoted risk value
4th week: 5% of quoted risk value
Subsequent weeks: 5% of quoted value

Special hire charges for long periods will be pre-arranged as stated on the order form. Items reserved and subsequently cancelled may be subject to a cancellation charge at the discretion of the Hirer.

Late Return Charges

A penalty charge of 10% of the quoted risk value will incur for each week past the agreed return date that the goods have not been returned to the Hirer by the Client.

Payment for late returns is due within 7 days of receipt of invoice by Client(s).

Extended Hire

In order to extend the hire period 48 hours notice prior to the previous agreed end date of the current hire period shall be Given in writing to the Hirer by the Client.

Extended hires are considered new hires and will be priced as such and subject to a new hire document. 

Payment for Services and Extended Hire

Payment is due for all services prior to collection or delivery. Payment is due for the extended hire period 48 hours prior to the commencement of extended hire date. If payment is not received 48 hours prior to the commencement of the extended hire date the extended hire will be cancelled.

Reservations

Reservations are made at the discretion of the Hirer, and costs may be associated.

Conditions of Goods

Goods are hired on the basis that they will be returned to the Hirer in the condition in which they were hired.

Collection and Delivery

Collection and return of goods is by Client, unless pre-arranged to the contrary when this service will be charged as an extra. No alterations shall be made without prior written consent of the Hirer and shall be subject to the conditions of such consent. Labels identifying items, as the property of the Hirer shall not be removed. The location of all items at all times shall be confirmed to the Hirer on demand. No items hired shall be used for any other purpose other than that for which such items are hired and shall not be lent or sub-hired to any third party.

A penalty charge of £25.00 for props returned without the Hirer’s paperwork.

The Warehouse is open Monday-Friday 9.00am - 5pm. The latest time for Pick up and Collections is 4.00pm

Packaging and Handling fees may be charged at the discretion of the Hirer for collections.

Once the goods have left the warehouse, the client is responsible for all damages and losses incurred. Goods damaged during transit where collection and delivery has been arranged by the client will be charged as listed below under Damages/Loss.

Receipt of Goods (Delivery Only)

On receipt of goods the client shall check the packaging for any damage and if there is any make a note on the delivery note in the presence of the driver. The client shall notify the Hirer immediately and send a photo of the damaged packaging. On receipt of goods the hirer should inspect the goods in full.

If the goods are damaged the Client should notify the Hirer immediately by phone and email a photo of the damage. Once goods have been delivered any damage caused to Goods of which the Hirer has not been notified will be charged to the client in full.

Loss / Damage

Goods should be kept in good condition and repair. Goods damaged or altered will be restored by the Hirer who will charge on the basis of cost of restoration. Goods not returned or which cannot be restored will be charged at insurance risk value as detailed on hire.

Payment due for any losses or damages within 14 days of the Client receiving the payment invoice.

Insurance

It is the responsibility of the Client to insure with reputable insurers at the insurance risk against loss or damage howsoever caused from time of collection until return and to produce a certificate of insurance on demand.

Fitness

The Client shall indemnify the Hirer against all claims and expenses in respect of damage injury or loss arising directly or indirectly out of the use or condition of the items and shall be responsible for selection. No warranty of fitness is given by the Hirer. The Client is respectfully reminded of copyright legislation and the Hirer shall not be liable for any possible copyright infringement.

Surety

The Hirer may request a surety and if this is agreed, the guarantee of the surety to the Hirer shall be for the due performance by the customer of all the hire terms and conditions and any time allowed or forbearance shown to the Client shall not relieve the surety from liability upon such guarantee.

Cancellations of Order

A cancellation charge of 50% of hire will be made for orders canceled within 24 hours of collection or delivery day.

Law

All parties agree English law applies and submit to the jurisdiction of the English Courts.

Artificial Intelligence

Any Goods hired by the Client(s) are not to be used or reproduced on screen through artificial intelligence.

Buy-Back

For hire purchases made by the Client(s), the Hirer reserves the right for the first opportunity to buy-back once Goods are no longer needed.

By placing an order with the Hirer the client accepts they:

1. Have read and accepted the hire terms and conditions printed above.
2. The hire terms and conditions will prevail at all times.
